This User Agreement governs your access to and use of westline.co.in (the "Site"), owned and operated by Westline Builders Private Limited ("Westline," "the Company," "we," "us," or "our"). By browsing the Site, submitting an enquiry, requesting a callback, or registering as a channel partner or landowner, you agree to be bound by this Agreement. If you do not agree, please discontinue use of the Site.
In this Agreement: "You" and "User" refer to any person accessing or using the Site. "Content" means all text, images, videos, floor plans, renders, graphics, and other material appearing on the Site. "Project" refers to any real estate development marketed by Westline on this Site, whether ongoing, upcoming, or completed.
This is the single most important section of this Agreement, and we want it read plainly rather than buried in legal language:

You are strongly advised to independently verify all project details, including RERA registration status, sanctioned plans, and title, through the Karnataka Real Estate Regulatory Authority (K-RERA) portal and your own legal counsel before making any financial commitment.
Subject to your compliance with this Agreement, Westline grants you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for your personal, non-commercial use in evaluating our projects and services. This licence does not include any right to resell, sublicense, redistribute, or make commercial use of the Site or its Content.
You agree that you will not:
We reserve the right to suspend or restrict access to any user who, in our reasonable judgment, violates this Agreement.
All Content on this Site — including the Westline name, logo, project names, floor plans, photography, video, and written material — is the property of Westline Builders Private Limited or its licensors, and is protected under applicable Indian intellectual property law, including the Copyright Act, 1957 and the Trade Marks Act, 1999. Nothing in this Agreement transfers any ownership or licence in our intellectual property to you beyond the limited viewing licence described in Section 3.
When you submit an enquiry, request a callback, register interest in a Project, or register as a channel partner or landowner through this Site, you expressly consent to Westline and its authorised representatives contacting you by phone, SMS, WhatsApp, or email in relation to that enquiry, including follow-up communication. You may withdraw consent to marketing communications at any time by contacting us using the details in Section 16; this does not affect our ability to respond to an active enquiry you have raised.
General information published on the Agents and Landowners pages of this Site — including illustrative commission structures, tier qualifications, or partnership models — is for informational purposes and does not itself constitute a binding offer or agreement. Any actual channel partner arrangement or landowner partnership (whether structured as a joint venture, outright purchase, or development agreement) is governed exclusively by a separate, specific written agreement executed between you and Westline, which shall take precedence over any general description on this Site in the event of conflict.
This Site may link to third-party platforms (including Google Maps, YouTube, Instagram, or payment/finance partner sites) for your convenience. Westline does not control, endorse, or accept responsibility for the content, accuracy, or practices of any third-party site, and your use of such sites is at your own risk and subject to their own terms.
To the maximum extent permitted by law, the Site and its Content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. While we take reasonable care to keep information current, Westline does not warrant that Content on the Site is free of error or that the Site will operate uninterrupted or error-free.
To the fullest extent permitted under Indian law, Westline Builders Private Limited, its directors, employees, and authorised representatives shall not be liable for any direct, indirect, incidental, special, or consequential loss or damage — including loss of profit, opportunity, or data — arising out of or in connection with your access to or use of this Site, or any reliance placed on its Content, save where such liability cannot lawfully be excluded. Nothing in this Agreement limits any statutory right or protection available to you as an "allottee" under the Real Estate (Regulation and Development) Act, 2016, in respect of a Project for which you have executed a formal Agreement for Sale.
You agree to indemnify and hold harmless Westline Builders Private Limited, its directors, officers, employees, and representatives from and against any claim, liability, loss, or expense (including reasonable legal fees) arising from your breach of this Agreement, your misuse of the Site, or your violation of any applicable law or third-party right in connection with your use of the Site.
Our collection and use of personal information submitted through this Site is governed by our Privacy Policy, which forms part of this Agreement by reference.
In accordance with the Information Technology Act, 2000 and rules made thereunder, the details of our Grievance Officer are published below for any complaints regarding Content on this Site or the handling of your personal information:
We will acknowledge and address grievances within the timelines prescribed under applicable law.
This Agreement is governed by the laws of India. Any dispute, controversy, or claim arising out of or in connection with this Agreement, or your use of the Site, shall first be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration shall be conducted by a sole arbitrator appointed by Westline Builders Private Limited, the seat and venue of arbitration shall be Mangaluru, Karnataka, and the proceedings shall be conducted in English. The arbitral award shall be final and binding on both parties. Subject to the foregoing, the courts at Mangaluru, Karnataka shall have exclusive jurisdiction over any matter not subject to, or arising from, the arbitration (including any application for interim relief).
We may revise this Agreement from time to time to reflect changes in our practices, our projects, or applicable law. The updated version will be posted on this page with a revised "last updated" date. Your continued use of the Site after such changes constitutes your acceptance of the revised Agreement.
If any provision of this Agreement is held invalid or unenforceable by a competent authority, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
This Agreement, together with our Privacy Policy and any project-specific Agreement for Sale you have separately executed, constitutes the entire agreement between you and Westline regarding your use of the Site, and supersedes any prior understanding on the subject.
Our failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.
